As of July 1, 2025, septic system inspection requirements have changed under Virginia law.

Real estate licensees will need to familiarize themselves with these requirements so they may educate their clients and ensure a smooth inspection process.

Key Provisions of HB2671

  • Only authorized inspectors may conduct septic system inspections, limited to individuals with a valid onsite sewage system operator, onsite sewage system installer, or onsite soil evaluator license
  • The law mandates a written contract between the inspector and the client detailing specific provisions of the inspection
  • The law sets new minimum standards for inspections of septic systems:
59.1-310.9 B 2 Authorized septic system inspectors shall inspect and report on all readily accessible and openable components, including septic tanks, pump tanks, distribution devices, treatment units, control panels, and dispersal fields. The inspection shall also include any components specified in the operation permit and any vegetation, grading, or signs of harmful water entry that may impact septic system function.
  • Inspectors must provide a written report of their findings within 10 days of the inspection, and the report must detail the condition of the septic system without issuing pass/fail results

Requirements for Real Estate Licensees

The law does not require septic system inspections when purchasing a property. However, it does apply if an inspection is requested in the purchase agreement.

Licensees should allow ample time for inspections. The new minimum standards for the inspection process may result in a more detailed and time-consuming inspection. Septic inspectors in the region recommend that licensees allow ample time for the inspection to be completed and for the report to be delivered.
