Smart home technology and other electronic devices designed to control or automate indoor temperature and/or indoor and outdoor lighting are commonly found in today’s homes. There is a broad spectrum of such devices that may be located in each individual home.
Paragraph 2 of the CVR MLS Purchase Agreement addresses these items:
Personal Property Included: Included with the sale of the above real estate (if located within said Property at the time of signing this Agreement, unless otherwise noted) are… network connected devices, hubs, and/or peripherals designed for controlling or automating temperature and lighting.
Listing agents should identify any electronic equipment that the seller does not wish to convey in the listing agreement and in the MLS listing or suggest that the seller removes the devices from the home prior to the start of showings.
Buyer agents should specifically identify any personal property, including smart home technology and electronic devices, that the buyer wishes to include in their purchase and list those items in Paragraph 2.
Some smart home devices may require hubs or other peripherals to fully function. Agents should negotiate the terms necessary to ensure these items are identified and addressed in the contract.
Below are examples of smart devices and electronic devices that may convey at closing:
- Hardwired doorbells
- Light Switches, especially those that require a hub to control features
- Ceiling lights, especially those that require a hub to control features
- HVAC electronic thermostats
- Irrigation Controls
- Door locks
