As of July 1, 2026, Paragraph 24G in the CVR MLS Purchase Agreement contains updated language regarding wood infestation. The contract now clarifies that only active wood infestation requires treatment. If there is damage from a prior infestation, it must be repaired. But treatment is only required if there is evidence of active infestation.
Key Considerations
- Paragraph 24G requires that any and all damage caused by wood-destroying insects be repaired, regardless of whether it is recent damage or damage from a previous infestation
- The CVR MLS As Is Addendum deletes paragraph 24G in its entirety, rendering the paragraph of no legal effect
- If the Purchaser is obtaining financing, depending upon the loan type, the lender may still require a WDI inspection
- The seller shall have any active infestation treated and any damage repaired by a licensed company
Insects within the scope of a standard wood-destroying insect (WDI) inspection:
- Subterranean termites (Reticulitermes spp. and Coptotermes Formosans)
- Drywood termites (Incisitermes spp.)
- Carpenter ants (Camponotus spp.)
- Carpenter bees (Xylocopa spp.)
- Old House Borers (Hylotrupes bajulus) and other wood-boring beetles
Mold, Fungi, and other household pests, such as roaches or spiders, are not included in the scope of a WDI inspection required in paragraph 24G.
